Notice on the right to inspect the electoral roll and the issue of polling cards for the elections to the European Parliament and the local elections on 9 June 2024

The electoral roll for the election to the European Parliament and the simultaneous local elections for the electoral districts of the City of Chemnitz will be closed from 20 May 2024 to 24 May 2024

in the postal voting office of the City of Chemnitz, Bürgerverwaltungszentrum I - Moritzhof (BVZ I - Moritzhof), Bahnhofstraße 53, for inspection by eligible voters. The postal voting centre of the City of Chemnitz is barrier-free. Every person entitled to vote can check the accuracy or completeness of the data entered about them in the electoral roll. If an authorised voter wishes to check the accuracy or completeness of the data of other persons entered in the electoral roll, he or she must provide credible evidence of facts that may indicate that the electoral roll is incorrect or incomplete. The right to verification does not apply to the data of eligible voters for whom a blocking notice pursuant to Section 51 (1) of the Federal Registration Act has been entered in the register of residents.

The electoral roll is kept in an automated procedure.

During the inspection period, extracts may be made from the electoral roll insofar as this is in connection with checking the voting rights of individual persons.

Only those who are entered in the electoral roll or have a polling card may vote.
Anyone who considers the voters' register to be incorrect or incomplete may lodge an objection or apply for it to be corrected at the City of Chemnitz, Postal Voting Office, BVZ I - Moritzhof, Bahnhofstraße 53, during the above opening hours from 20 May 2024 to 24 May 2024. The objection or request for correction can be submitted in writing or by declaration for recording (postal address: City of Chemnitz, postal voting centre, P.O. Box 1161, 09070 Chemnitz).
Eligible voters who are entered in the electoral roll will receive a polling card by 19 May 2024 at the latest.

Anyone who has not received a voter's notification but believes they are entitled to vote must lodge an objection to the electoral roll if they do not want to run the risk of not being able to exercise their right to vote.

Eligible voters who are only entered in the electoral roll upon application and who have already applied for a polling card and postal voting documents do not receive a voter's notification.
Anyone who has a polling card for the election to the European Parliament can vote in this election by casting their vote in any polling station in the city of Chemnitz or by postal vote.

Anyone who has a polling card for the local elections can participate in the election to the city council by voting in any polling station in the constituency for which the polling card was issued or by postal vote; in the case of simultaneous local council elections, voting in person in the polling station for both the city council and the local council election is only possible in any polling station in the corresponding locality.
A polling card is issued upon application
5.1 Eligible voters entered in the electoral roll,
5.2 eligible voters not entered inthe electoral roll,
a) if they can prove that, through no fault of their own, they have missed the deadline for applying for inclusion in the voters' register for thefor the election to the European Parliament for Germans pursuant to Section 17 (1) of the European Election Code, for EU citizens pursuant to Section 17a (2) of the European Election Code until 19 May 2024 or the objection period. 2024 or the objection deadline against the electoral roll pursuant to Section 21 (1) of the European Election Code or the deadline for filing an application for correction pursuant to Section 4 (2), (3) of the Local Elections Act by 24 May 2024,
b) if their right to participate in the elections only became effective after expiry of the application deadline for Germans pursuant to Section 17 (1) of the European Electoral Regulations, for EU citizens pursuant to Section 17a (2) of the European Electoral Regulations or after expiry of the objection period pursuant to Section 21 (1) of the European Electoral Regulations or the deadline for filing an application for correction pursuant to Section 4 (2) and (3) of the Local Elections Act,
c) if their right to vote has been determined in the objection or complaint procedure and the electoral authority only became aware of the determination after the finalisation of the electoral roll.

If the applicant is authorised to vote in the city council and a local council election, he or she will only receive one joint polling card for both elections. A separate ballot paper is always issued for the election to the European Parliament.

Eligible voters entered in the electoral roll may apply for a polling card up to 6:00 p.m. on 7 June 2024 at the City of Chemnitz, postal voting office, BVZ I - Moritzhof, Bahnhofstraße 53, orally, but not by telephone, in writing (postal address: City of Chemnitz, postal voting office, P.O. Box 1161, 09070 Chemnitz) or in documentable electronic form (online application for a polling card at www.chemnitz.de/briefwahl or by email via briefwahl(at)stadt-chemnitz.de).

In the event of demonstrably sudden illness that makes it impossible or unreasonably difficult to go to the polling station, the application can still be submitted until 3.00 pm on election day.

If an authorised voter credibly asserts that he or she has not received the requested ballot papers, new ballot papers may be issued until 12:00 noon on the day before the election.

Eligible voters not entered in the voters' register may apply for a polling card up to 3.00 p.m. on election day for the reasons stated under 5.2, letters a) to c).

Anyone submitting the application on behalf of another person must prove that he or she is authorised to do so by submitting a written power of attorney. An authorised voter who is unable to read or is prevented from submitting an application due to a physical impairment or disability may use the assistance of another person to submit the application. Polling cards and postal voting documents may only be handed over to a person other than the person entitled to vote in person if authorisation to receive them is proven by submitting a written power of attorney. The power of attorney may only be used if the authorised person does not represent more than four eligible voters; they must confirm this in writing before receiving the documents. Upon request, the authorised person must provide proof of identity.
Enclosed with the respective polling card are
- the election to the European Parliament:
  - an official ballot paper,
  - an official white ballot paper envelope,
  - an official red ballot paper envelope labelled with the address to which the ballot paper is to be returned, and
  - an information sheet for postal voting
- the municipal election(s)
  - an official ballot paper for the city council election,
  - if eligible to vote in a local council election: an official ballot paper for the local council election,
  - an official yellow ballot paper envelope,
  - an official green ballot paper envelope labelled with the address to which the ballot letter is to be returned and
  - an information sheet for postal voting.
Who votes by postal ballot
- personally marks the respective ballot paper(s),
- places it in the official white ballot paper envelope for the election to the European Parliament and in the yellow ballot paper envelope for the city council and, if applicable, the local council election and seals them,
- signs the corresponding affirmations in lieu of oath for the postal vote, stating the date of signature,
- places the sealed ballot paper envelopes and the relevant ballot papers together in the official ballot paper envelopes (European Parliament elections: red ballot paper envelope, city council and local council elections: green ballot paper envelope) and
- sends the postal ballot letters to the address printed on the envelope.

If the voter uses an assistant, the assistant must confirm by signing the affirmation in lieu of an oath that they have marked the ballot paper in accordance with the voter's declared wishes. The assistant must have reached the age of 16. The assistance is limited to technical assistance in announcing a voting decision made and expressed by the voter him/herself. Assistance is not permitted if it is provided under improper influence, if it replaces or changes the self-determined decision of the person entitled to vote or if there is a conflict of interest on the part of the assistant. The assistant is obliged to keep confidential any knowledge of another person's vote that they have obtained in the course of providing assistance.

In the case of postal voting, the voter must send each of the ballot letters with the ballot paper(s) and the ballot paper(s) to the specified office in good time so that the ballot letters arrive there by 6 p.m. on election day at the latest.

Within the Federal Republic of Germany, postal ballot letters are sent free of charge as standard letters without any special form of dispatch exclusively by Deutsche Post AG. They can also be handed in at the office indicated on the respective ballot letter.

Information on data protection

This notice is also the data protection information for data subjects within the meaning of Article 13 of the General Data Protection Regulation on the personal data processed for the correction of the electoral roll and for the issue of a polling card:

1.

a) If an application for entry in the voters' register has been made or an objection has been lodged against the accuracy or completeness of the voters' register, the processing of the personal data provided in this context for the purpose of processing the application or objection is carried out on the basis of Article 6(1)(c) and (e) of the General Data Protection Regulation in conjunction with Section 4 of the European Elections Act. § Section 4 of the European Elections Act, Section 17(1) of the Federal Elections Act and
§§ Sections 14 to 17b, Sections 20 to 22 of the European Election Code and in conjunction with §§ Sections 4, 33, 37a, 48 of the Local Elections Act and Section 9 of the Saxon Local Elections Code.

b) If an application for a polling card has been submitted, the personal data provided in this context will be processed in order to process the application on the basis of Article 6(1)(c) and (e) of the General Data Protection Regulation in conjunction with Section 4 of the European Elections Act.
§ Section 4 of the European Elections Act, Section 17(2) of the Federal Elections Act and Sections 24 to 29 of the European Elections Code as well as in conjunction with §§ Sections 5 (1), 33, 37a, 48 of the Municipal Elections Act and
§§ Sections 12 and 13 of the Saxon Local Election Code.

c) If you have issued a power of attorney to apply for a polling card and/or to collect the polling card with postal voting documents, the personal data provided by you and the authorised representative in this context will be processed to check the authorisation and the authorisation of the authorised representative to apply for a polling card and/or to receive the polling card and the postal voting documents. the receipt of the polling card and postal voting documents on the basis of Article 6(1)(c) and (e) of the General Data Protection Regulation in conjunction with Section 4 of the European Elections Act. with Section 4 of the European Elections Act, Section 17 (2) of the Federal Elections Act and Section 26 (3), Section 27 (5) of the European Elections Code as well as in conjunction with §§ 5 Paragraph 1, 33, 37a, 48 of the Local Elections Act and § 13 Paragraph 2, § 14 Paragraph 4 and 6 of the Saxon Local Elections Code.

d) The municipality keeps registers of issued ballot papers, § 27 Paragraph 6 of the European Election Code, § 14 Paragraph 8 of the Saxon Local Election Code, a register of ballot papers declared invalid, § 27 paragraph 8 of the European Election Code, § 14 paragraph 11 of the Saxon Local Election Code, as well as a list of authorised representatives and the ballot papers issued to them, § 14 paragraph 4 sentence 5 of the Saxon Local Election Code.

2 You are not obliged to provide the personal data. It is not possible to process the application for entry in the electoral roll, the objection to the electoral roll and the application for the issue of a polling card or the issue or delivery of the polling card and postal voting documents to an authorised representative without the information.

3. the municipality is responsible for processing the personal data provided. The contact details of the official data protection officer are

4. In the event of a complaint against the refusal of entry in the electoral roll, against the rejection of an objection to the electoral roll or against the refusal of a polling card, the recipient of the personal data for the election to the European Parliament is the City Electoral Officer (postal address: City of Chemnitz, Dezernat 1, 09106 Chemnitz), for the local elections the State Directorate of Saxony (location, postal address: Landesdirektion Sachsen, Altchemnitzer Straße 41, 09120 Chemnitz) as the responsible legal supervisory authority. In election review/challenge proceedings, the competent legal supervisory authorities, the administrative courts and the Saxon Constitutional Court and, in the case of electoral offences, the criminal prosecution authorities and other courts may also be recipients of the personal data.

5. Electoral rolls, lists of ballot papers, lists of invalid ballot papers as well as lists of authorised representatives and the ballot papers issued to them are to be made accessible to the public.and the ballot papers issued to them must be destroyed six months after the election, unless pursuant to Section 83 Paragraph 2 of the European Election Code, Section 62 Paragraph 2 of the Saxon Local Election Code

the Federal Returning Officer orders otherwise in view of pending electoral scrutiny proceedings,
the decision on the validity of the local election is still contested or
they may be of significance to the prosecuting authority for the investigation of an electoral offence.

6 If the legal requirements are met, you have the following rights:

Restrictions arise from the provisions of electoral law, in particular the provisions on the right to inspect the electoral roll and to receive a copy, Section 4 of the European Elections Act, Section 17 (1) of the Federal Elections Act in conjunction with § Section 20 of the European Election Code; Sections 4 (2), 33, 37a, 48 of the Local Elections Act in conjunction with § Section 8 (2) and (3) of the Saxon Local Elections Code, by the provisions on objections and complaints against the electoral roll, Section 4 of the European Elections Act, Section 17 (1) of the Federal Elections Act in conjunction with Sections 21 and 22 of the European Elections Code. §§ Sections 21 and 22 of the European Election Code; Sections 4 (3) and (4), 33, 37a, 48 of the Municipal Election Act in conjunction with Section 9 (1) of the Saxon Election Code. § Section 9 (1) of the Saxon Local Elections Code and the cancellation periods (see point 5).
