Removal of the 30 km/h speed limit signs on Bornaer Straße
On 2 September 2014, the Zschopau branch of the State Office for Road Construction and Transport instructed the City of Chemnitz Civil Engineering Department to remove the 30 km/h signs on Bornaer Straße between Sandstraße and Leipziger Straße by 12 September 2014. The city council had installed the 30 km/h speed limit signs with a view to noise protection for the local population.
The decision by the LASuV was preceded by a notice of objection from the state office to a local company, which had lodged an objection to the traffic order issued by the civil engineering office in June 2011. The civil engineering office initially rejected the objection and referred to the noise calculations that had been carried out and the need to protect neighbouring residents on Bornaer Straße. The appellant was also informed that the operational restrictions were reasonable in relation to noise protection. The Sandstraße site also remains connected to 50 km/h motorways via Bornaer Straße and Chemnitztalstraße (B107).
In the opinion of the state office, however, the calculated noise levels are not sufficient for such traffic restrictions and the company's operational interests have been unduly impaired by the 30 km/h regulation.
The Zschopau branch of the State Office for Road Construction and Transport, as the responsible appeal authority, therefore came to the conclusion that the signage must be removed.
