Promotion of occupancy rights to flats
The administrative districts and independent cities can establish occupancy rights to vacant, usable flats owned by private homeowners. The right of occupancy is granted by the landlord for a period of 5 years upon conclusion of the tenancy agreement. In return, the landlord receives a one-off payment of between €3,000 and €5,000 per flat from the City of Chemnitz in addition to the rent, depending on the size of the flat. The flat can then be occupied by asylum seekers for the duration of the earmarking by the city. Tenants whose asylum procedure has been completed and who receive benefits in accordance with the German Social Security Code may also be entitled to reside in the apartment.
Financial resources are still available from the contingent for the city of Chemnitz. After analysing the housing offers received and identifying priority needs, the following flats are still required:
I) 10 accessible wheelchair-accessible flats
The housing requirement under point I) is independent of the location in the city area.
Furthermore, occupancy rights for
II) 10 one-room flats
III) 3 to 4-room flats and larger
(in particular for family reunification for asylum seekers with the right to stay)
for flats located in the following districts:
Adelsberg, Altendorf, Borna-Heinersdorf, Erfenschlag, Euba, Glösa-Draisdorf, Grüna, Harthau, Kaßberg, Klaffenbach, Kleinolbersdorf-Altenhain, Mittelbach, Rabenstein, Reichenbrand, Reichenhain, Rottluff, Röhrsdorf, Schlosschemnitz, Schönau, Siegmar, Stelzendorf and Wittgensdorf.
The establishment of occupancy rights must be applied for by the owner on the basis of a housing offer. The application must be submitted in writing in paper form by 26 February 2016. A separate application must be completed for each flat offered. The application for the right of occupancy is also required from owners who have already submitted a housing offer to the city; rental agreements concluded before 23 October 2015 cannot be considered.
