At its meeting today, the Chemnitz City Council confirmed the revised content of the City of Chemnitz police regulations for maintaining public safety and order in Chemnitz. The city council had already decided to amend the previous version from 2018 in June 2024.
The City of Chemnitz police ordinance contains regulations on environmentally harmful behaviour, disruptive behaviour in public, animal husbandry and contamination by animals as well as feeding bans on wild animals, protection against noise pollution, such as protection of the night's rest and also through house and garden work, as well as other public concerns, including the holding of events and the burning of open fires. It also regulates the affixing of house numbers.
In addition to conceptual changes and clarifications of language and content, the new version now contains a separate regulation for the prohibition of begging by children or accompanied by children. This introduces a general ban on "child begging", regardless of the specific type and manner. The aim of the ban is to protect children from risks to their welfare, to promote their rights as independent individuals and to ensure child-friendly living conditions.
Another new provision is that it is prohibited on public roads, in green and recreational areas and in other publicly accessible areas to cause a considerable nuisance to other persons through intrusive or aggressive behaviour, e.g. after consuming alcohol or other intoxicating substances, or to prevent them from using these areas in accordance with public use. There is a public interest in the inclusion of this regulation in the city of Chemnitz, particularly in the city centre district.
The regulation on the obligation to notify public events that are not subject to the Saxon Assembly Act or take place exclusively in an assembly venue authorised for this purpose in accordance with the Saxon Assembly Venue Ordinance is broader and more specific in the new version. The revision introduces a notification requirement for certain public events based on the expected/planned number of participants or if the legal interests of third parties or public safety are recognisably affected. Events above a certain number of participants involve a considerable amount of planning and require close co-operation between the authorities and agencies involved. The notification requirement is intended to ensure that the regulatory authority is informed in good time and comprehensively about all events of a certain size or with certain effects in its municipal area. Only on this basis can it assess the circumstances and coordinate any necessary official measures in a timely manner.
The previous regulation on the depositing of recyclable materials in the designated collection containers in publicly accessible areas is no longer included in the new police ordinance, as it is already contained in the waste statutes of the City of Chemnitz.
The newly revised police regulations of the City of Chemnitz come into force on the day after their public announcement in the official gazette. At the same time, the police ordinance that came into force on 21 July 2018, including the editorial amendment of 31 August 2018 and the amendment following the City Council resolution in June 2024, which came into force on 3 August 2024, will cease to apply.
