Mayor Sven Schulze objects to City Council resolution B-131/2026, which was not adopted, entitled ‘Resignation of Councillor Karl Kohlmann from the Chemnitz City Council and appointment of a replacement’, dated 9 September 2026.
The reason for this is the bias of a city councillor during the vote. The subject of draft resolution B-131/2026 was the resignation of City Councillor Karl Kohlmann from the City Council of Chemnitz. Consequently, a conflict of interest exists both in the case of Karl Kohlmann and, due to the degree of kinship in accordance with Section 20(1)(2) of the Saxon Local Government Act (SächsGemO), in the case of Martin Kohlmann. Karl Kohlmann was not present at the meeting for this agenda item.
In breach of Section 20(4) of the Saxon Local Government Act (SächsGemO), Martin Kohlmann failed to leave the meeting area despite having a conflict of interest and took part in the vote on the draft resolution, as well as explaining his voting behaviour.
As the provisions of Section 20(1) and (4) of the Saxon Local Government Act have thus been breached, Resolution B-131/2026 is consequently unlawful.
For this reason, draft resolution B-131/2026 is hereby re-scheduled, within the prescribed time limit, on the agenda of the scheduled City Council meeting on 7 October 2026.
