Further objection to City Council Resolution B-131/2026

Mayor Sven Schulze has once again objected to City Council resolution B-131/2026, ‘Resignation of Councillor Karl Kohlmann from the Chemnitz City Council and appointment of a replacement’, dated 7 October 2026.

The reason for this is that, from the administration’s point of view, the City Council has no discretion of its own when determining Karl Kohlmann’s retirement on grounds of age. As the reason for his retirement is defined by law, the City Council is not permitted to carry out any additional assessment on a case-by-case basis. It must merely verify whether the relevant statutory ground has in fact been met.

The majority rejection of Karl Kohlmann’s resignation from the Chemnitz City Council pursuant to Section 18(1), second sentence, No. 1 of the Saxon Local Government Act (SächsGemO) is therefore unlawful.

In accordance with Section 52(2) of the Saxon Municipal Code (SächsGemO), the Lord Mayor will inform the State Directorate of Saxony today in order to seek its ruling on the legality of the resolution.
