Video surveillance does not have to be switched off
Necessary data protection impact assessment is available
Contrary to media reports from 10 October 2018, video surveillance in Chemnitz city centre does not have to be switched off. The data protection impact assessment required for the operation of such a system is available for all parties involved in the project, i.e. the City of Chemnitz, CVAG and C³ Chemnitzer Veranstaltungszentren GmbH.
In accordance with the European General Data Protection Regulation (GDPR), there is no obligation to submit such a data protection impact assessment to the responsible data protection officer. Likewise, no authorisation by the latter is required. In accordance with Article 35 of the GDPR, the advice of the data protection officer should be sought when carrying out a data protection impact assessment. As the lead project partner, CVAG sent a draft of the data protection impact assessment to the Saxon Data Protection Commissioner back in July 2018 and asked for an assessment. The resulting information was also incorporated into the identical data protection impact assessments of the City of Chemnitz and C³ Chemnitzer Veranstaltungszentren GmbH. The City of Chemnitz is in regular dialogue with the Saxon Data Protection Commissioner.
