Following a comprehensive review of the Chemnitz Administrative Court's decision of 27 August 2025 regarding the recognition of the AfD city council faction, the City of Chemnitz will not lodge an appeal with the Higher Administrative Court.
Lord Mayor Sven Schulze: "Even if the reasoning behind the court decision leaves questions unanswered, we will refrain from taking further legal action in the interests of the city. We have already lost a considerable amount of time due to the months of internal party disputes within the AfD and the resulting delay in appointments to committees and advisory boards. A continuation of the dispute would only unnecessarily hinder the work of the committees, advisory boards and ultimately the Chemnitz City Council."
Due to the formation of two AfD parliamentary groups, a new decision on the composition of the committees, advisory boards and supervisory boards must be made at an extraordinary city council meeting on 15 September. Committee seats can be allocated by agreement, nomination procedure or election. The City Council will decide which procedure is to be used.
Lord Mayor Sven Schulze adds: "It is possible that the allocation of seats in the committees will no longer fully reflect the election results of the City Council elections on 9 June 2024. However, the administrative court has made it clear in its ruling that party affiliation is independent of party affiliation. In this respect, it is up to the city council to decide how to deal with this situation in future."
