What does a voluntary legal carer do?
If an adult is unable to manage all or part of their affairs due to illness or disability, the guardianship court appoints a legal guardian for them (Section 1896 BGB). This guardianship enables the legal representation of this person and is to be distinguished from social care, such as nursing and domestic help. Guardianships are set up by the guardianship courts as part of court proceedings for adults in need of assistance who are unable to manage all or part of their own affairs due to mental illness or a physical, mental or emotional disability.
