New version of the city's market statutes
As an organiser, the City of Chemnitz runs weekly, special, flea and annual markets as well as the Chemnitz Christmas market. This is regulated in the City of Chemnitz's market statutes.
At its meeting yesterday, the City Council decided to revise individual sections of the City of Chemnitz's market statutes. The relevant draft resolution no. B-072/2016 had previously been discussed by the Administration and Finance Committee on 7 April 2016.
The market statutes of the City of Chemnitz were last amended as a result of Art. 18 of the law accompanying the 2015/2016 double budget of 29 April 2015.
Following yesterday's resolution, the following content was amended, supplemented or adapted in the City of Chemnitz's market statutes:
§ Section 6 - Set-up and dismantling
Under paragraph (4), which regulates the provision of electricity for the market stalls, it was added that stall holders must provide electrical cables leading from the power distribution system to the sales equipment and lay them properly so that they do not pose any danger.
§ Section 7 - Sales facilities
This paragraph stipulates, among other things, that sales facilities must be clean and stable and may only be set up in such a way that they do not damage the market surface. The sales facilities must also be in a clean condition and their external design must reflect the character of the market.
Paragraph (4) has also been added to § 7.
which, among other things, only permits advertising and the display of signs and posters within the sales facility. A new feature is that the market stalls will be numbered in future. This change has been made for customer convenience, e.g. to enable traders to be located, but also to enable emergency services to be quickly directed to the market in the event of an emergency.
§ 8 - Behaviour at markets
Amendments have also been made to Section 8 of the City of Chemnitz Market Statutes, which regulates behaviour at Chemnitz markets: In any case, it was previously illegal to distribute advertising material that had nothing to do with the product range offered by the traders on site.
Now, the organiser's permission is expressly required, even if the trader wishes to advertise their product range on offer at the market with flyers and other materials.
Furthermore, begging at the city's markets is not permitted. This applies according to the new version of the market statutes as per § 8.
§ 13 - Administrative offences
This paragraph has been adapted due to a change in the law.
The amount of the warning fine for the punishment of administrative offences, which previously amounted to a maximum of EUR 35.00, has now been increased to a maximum of EUR 55.00.
§ Section 14 - Market ban
Finally, § 14 has also been revised. To ensure order, this section of the bylaws now stipulates the following: "Anyone who significantly or repeatedly disrupts public safety and order at the market despite being warned may be excluded from participating in or visiting the market."
The amended market bylaws that have now been adopted enter into force upon publication in the Official Gazette.
