Mayor informs committee about current status of stadium renovation
Focus topic: Decision of the public procurement chamber
This afternoon, Lord Mayor Barbara Ludwig informed the Planning, Building and Environment Committee about the current status of the stadium remodelling as scheduled.
The main focus was once again on summarising the award procedure:
After evaluating the three binding bids submitted in accordance with the known evaluation criteria (55 per cent price, 45 per cent other criteria such as functionality, design, technical building equipment, accessibility, etc.), the city, as the client, decided to award the contract as general contractor to the bidding consortium BAM/BAM Sports. The jury formed specifically for the award process also recommended awarding the contract to this bidder in June. The unsuccessful bidders lodged complaints and applications for a review of the contract award with the procurement chamber of the Saxony state directorate against this planned award. One company withdrew this application in the course of the proceedings.
In a decision dated 28 August, the award chamber determined that
- the chosen evaluation system complied with public procurement law.
- the city had exercised the scope for judgement incumbent upon it without error.
- the principles of equal treatment and transparency were not violated.
- the award procedure was not influenced by the jury or consulting third parties
by the jury or consulting third parties.
Köster's application was therefore rejected. The company has until 13 September to lodge an appeal against this decision with the Dresden Higher Regional Court. If it does not do so, the city can award the planned contract to BAM/BAM Sports on 16 September.
"I hope that the Köster company, which has already successfully built in our city, will accept the decision of the procurement chamber and that we can move forward in the interests of the matter," said Mayor Ludwig.
The next steps following the award of the contract would be the approval and implementation planning by the general contractor, which also includes the construction schedule, as well as the building application process, for which everything necessary has been prepared within the city administration.
The Lord Mayor also provided information on the subsidy procedure. For reasons of legal certainty against the background of corresponding enquiries in other EU member states and on the advice of the Free State, the city had notified the European Commission of the complete remodelling at the beginning of the year. This notification procedure concerns compliance with competition law and the question of whether it is permissible under state aid law to lease the stadium to a third division club. In this procedure, the city is working together with the Federal Ministry of Economics as the EU contact and the Saxon Ministries of Economics and Labour and of the Interior, which consider this conversion measure to be unproblematic. The city has also followed the same path as the cities of Erfurt and Jena, whose stadium conversion projects were recently approved by the EU.
Keyword stadium
The remodelling of the stadium on Gellertstraße is to be carried out without interrupting match operations and with a maximum budget of 25 million euros. A modern arena with 15,000 seats is planned, of which approx. 9,000 seats and 6,000 standing places, including a family block and barrier-free seats. The client is the city of Chemnitz.
