Inspection of the register of building encumbrances - application is now possible online

Since this week, Chemnitz residents have been able to easily, conveniently and digitally request an inspection of the register of building encumbrances from the City of Chemnitz via its Amt24 online portal.

When assuming a building owner function on a property, the building owner must also deal with the question of which public law obligations are associated with the property. In principle, only matters relating to building law can be the subject of building charges.

In any case, all matters for which legal security is prescribed in the Saxon Building Code are eligible for building charges.

Some examples of this are

  • Securing access roads via other properties
  • Securing clearance areas on other properties
  • Securing distances required for fire protection reasons on other properties
  • Securing parking spaces required by building regulations (cars, bicycles) on other properties

As a rule, this requires a written declaration from the property owner to the building supervisory authority. Once a declaration has been made by the property owner, it also applies to the legal successor (e.g. purchaser).

Anyone who can demonstrate a legitimate interest can inspect the register of building encumbrances or obtain copies. This is regulated in § 83 Para. 5 of the Saxon Building Code.
Applications can now also be made digitally via the Amt24 cross-administrative service portal.

The service "Information on building encumbrances - requesting access to the register of building encumbrances" is a further building block in the implementation of the Online Access Act (OZG). This law obliges the federal, state and local authorities to offer all suitable administrative services in Germany digitally via administrative portals and to link their administrative portals to form a network. In Saxony, a joint project approach is being implemented between the Free State and its municipalities.

In future, citizens, companies and organisations will be able to easily access online administrative services via the Saxon cross-administrative service portal Amt24(www.amt24.sachsen.de).

The prerequisite for using all services is at least a one-off and free registration and creation of a service account (under "My service account") on the Amt24 service portal.

In implementing its Digital Agenda, the City of Chemnitz has been gradually modernising all suitable services and administrative processes internally and externally in a strategic project since last year. The aim is to ensure that the online processes can be used successively via a standardised administrative portal in a legally compliant and data protection-compliant manner. Not only will the data be recorded in a standardised and digital format, but the aim is also to ensure that the data can be further processed without media discontinuity in the corresponding distributed specialist procedures and in the city-wide electronic file management system.

The City of Chemnitz has drawn up a roadmap for the TOP50 services for the online processes, which is currently being implemented step by step as part of the project work.
