Facility-based compulsory vaccination

Information on the implementation of the legal regulations in the city of Chemnitz from 16 March

From 16 March 2022, persons employed in medical facilities such as hospitals, doctors' surgeries or nursing homes will be required to have a COVID-19 vaccination. If the obligation to provide proof cannot be met, the facility managers are obliged to report this to the public health department. The law to strengthen vaccination prevention against COVID-19 (Section 20a IfSG) came into force on 12 December 2021.

Obligation to provide evidence

The law (Section 20a (2) sentence 1 IfSG) stipulates that staff in the affected facilities who have contact with patients or people in need of care must submit one of the following proofs of immunity against COVID-19 to the respective facility management by the end of 15 March 2022:

  • valid proof of vaccination
  • valid proof of recovery
    or
  • a medical certificate stating that they cannot be vaccinated against the SARS-CoV-2 coronavirus due to a medical contraindication.

Obligation to register

If this proof has not been provided by the end of 15 March 2022 or if there are doubts about the authenticity or accuracy of the submitted proof, the facility management must immediately inform the Chemnitz public health department and transmit the personal data (Section 20a (2) sentence 2 IfSG). The obligation to notify the public health department also includes the management of the facility or company if it is unable to provide one of the above-mentioned proofs.


Deadlines

Notification is only possible electronically via the City of Chemnitz's notification portal and should not be made before 16 March 2022. Persons who are unable to provide proof from 16 March 2022 will be asked by the public health department to submit this within a period of four weeks. If two vaccinations are still required, proof of the first vaccination must be provided within four weeks. Proof of the second vaccination must be submitted after two months at the latest. If no proof is provided within the specified deadlines despite the request, the health authority may issue a ban on entry or activity. The principle of security of supply must be applied in all cases. However, anyone starting a new job on 16 March 2022 must submit proof of vaccination or recovery to their employer before starting work.
