Chamber has ruled: City's decision to award contract for stadium remodelling was lawful
The Public Procurement Chamber of the State Directorate of Saxony has ruled: The objection to the city's planned award of the stadium remodelling contract was rejected, thus confirming the city's decision as lawful.
Following a multi-stage negotiated procedure, the City of Chemnitz intends to award the contract for the complete remodelling of the stadium on Gellertstraße to the bidding consortium BAM Sports GmbH Düsseldorf and BAM Deutschland AG Stuttgart as general contractor. Two other bidders objected to this decision and each filed an application for a review of the award with the Saxony Public Procurement Chamber. One bidder has since withdrawn its application for review. The award chamber has now ruled on the pending application.
The evaluation system, which was known to all bidders when they submitted their bids and which took into account 55 per cent price and 45 per cent criteria such as functionality, architecture and design, technical building equipment and accessibility, was expressly classified as admissible by the awarding chamber.
After examining the tender documents and as a result of the oral hearing, the chamber came to the conclusion that the principle of equal treatment and transparency was strictly adhered to by the city and that the evaluation of all tenders was carried out in accordance with public procurement law.
"I am pleased with the clear assessment of the procurement chamber, which also confirms that we have done a good job," said Lord Mayor Barbara Ludwig. "In the interests of the project, I now hope that the unsuccessful bidder will accept the Chamber's decision so that we can award the contract without further delay and move forward with the stadium renovation."
If no further appeals are lodged, the decision of the awarding chamber will become legally binding two weeks after it is served on the unsuccessful bidder. The city can then award the planned contract. The specific schedule for the construction process will then be determined together with the general contractor.

The remodelling of the stadium on Gellertstraße is to take place without interrupting match operations and with a maximum budget of 25 million euros. A modern arena with 15,000 seats is planned, of which approx. 9,000 seats and 6,000 standing places, including a family block and barrier-free seats. The client is the city of Chemnitz.
